3. Rental Terms and Conditions Read and confirm rental reservation

In order to have a safe and enjoyable rental experience, we ask you to fully understand and accept these conditions.

Pickup Information and Options

We are located at 6802 Post rd, North Kingstown RI 02852. If you wish to pick up a rental in store, we still require that you reserve the rental prior to coming in to pick up your product. Please read terms and conditions of in store pick ups.

If product picked up in store, renter is responsible for safe transportation and any damages incurred once product has left the store location.

Delivery Information and Options

For white Glove Delivery: With our white glove delivery service, we will deliver anywhere within a 60 mile radius of our 6802 post rd. North Kingstown Location. Included in this service is a set up and instruction tutorial by one of our highly trained technicians. We pride ourselves in this service because we want to go above and beyond to ensure that you and your loved ones are not only equipped with the products you need, but the knowledge on how to operate them as well.

Our base delivery fees are calculated under the assumption that there are no barriers to delivering your rental product. If there is no ramp at the delivery location, or a viable way of bringing in the product easily, this may be a two person job and/or require additional ramping/equipment.

We reserve the right to reassess delivery charges based on home and/or delivery location access. In case of rush, emergency delivery, or any other extenuating circumstances, please contact us immediately so we can evaluate and assess proper delivery methods.

Payment:

Payment shall be made to Mobility Equipment Recyclers Of New England LLC. Renter agrees to pay for items being rented, prior to shipment and or delivery of items. If any invoice is not paid when due, Mobility Equipment Recyclers Of New England reserves the right to withhold items until full payment has been received. A deposit will be required in order to reserve desired rental equipment. Any and all deposits are non-refundable if the renter cancels outside of the 48 hour time frame cancellation guidelines.

Order Cancellations and Refunds:

Renter has 48 hours to cancel from date of initial reservation for a full refund. A 50% of the rental total fee will be applied to any orders cancelled after the first 48 hours. If reservation is made within 48 hours of required delivery/pick up date, the renter is able to cancel, but a 50% of the order total fee will be applied. If Renter does cancel within 48 hours, a full refund will be assessed. If Renter decides to cancel during the rental period for any reason other than defective equipment, Mobility Equipment Recyclers of New England LLC reserves the right to withhold any and all payments.

Guarantee:

Mobility Equipment Recyclers of New England LLC will guarantee the normal functionality of rental item. This guarantee does not cover user error or neglect. If Renter has any questions or concerns about Mobility Equipment Recyclers of New England LLC guarantee, Mobility Equipment Recyclers Of New England LLC should be contacted for further clarification and or the completion of a separate agreement. There shall be no warranties either express or implied set forth outside of this agreement unless specified in a written form.

Fit:

If agreed upon, Mobility Equipment Recyclers Of New England LLC will customize and or fit the product being rented to the user based on the measurements and information provided by renter and its agents. A fee will be assessed for fitting and customization. Mobility Equipment Recyclers Of New England LLC will to the best of their ability match the specifications provided to the product being rented if previously agreed upon. If customizations and or modifications are not previously agreed upon, Mobility Equipment Recyclers Of New England LLC will not customize or alter the product being rented from its original state. Issues that arise as a result of lack of fit will be the responsibility of the renter to remedy. Additional work and or charges may need to be assessed. Modifications to rented equipment is not permitted in any form by any other person, persons, entities or other. Mobility Equipment Recyclers of New England LLC will perform any modifications unless agreed upon in written form. Without proper measurements and or information provided, arising from miscommunication, geographical location/accessibility or other, Mobility Equipment Recyclers Of New England LLC has limited ability to fit the product or products being purchased to the end user accurately, therefore Mobility Equipment Recyclers Of New England LLC is not responsible if the product is received and does not fit the user as a result.

Installation:

Products such as ramps, stairlifts, platform lifts and other mobility devices may require installation and modification to renter’s home,property or land. Renter acknowledges that changes may need to be made and or the product may need to be installed in order to accommodate the rental. Renter shall defend, indemnify and hold harmless Mobility Equipment Recyclers of New England LLC and all of their agents, officers, servants, and employees from and against claims of damage other than gross misconduct or neglect. Renter assumes all risk and liability for including, but not limited to, any loss, damage or injury, including death, to persons, or property of renter, or others arising out of the use, operation, transportation or driving of the equipment.

Operations & Maintenance:

The assigned user of the rented equipment shall use the equipment in a prudent and proper manner while in compliance with all applicable manufacturer's specifications and government requirements. The user of this equipment shall not make any alterations, repairs, improvements, or cover up any damage caused by the assigned user. The operation of this equipment is only to be used by the assigned users of this agreement who have been properly trained and educated on operation and maintenance. Upon request, The maintenance and operations procedure for said equipment may be provided in a written document, stating how to properly use the equipment. Any family member, friend, caretaker, medical technician, physical therapist etc. who will be using this equipment, needs to be trained on maintenance & operation before use of equipment may be allowed. All users of this equipment agree to sign this document stating that they were properly trained and know how to operate and maintain the equipment that is being rented.

Subject to all the terms and conditions set forth in this Rental Agreement, the Renter agrees:

The device being rented, including, but not limited to electric wheelchairs, scooters, hospital beds, patient lifts, ramps, walkers, and any other device being rented, is the property of Mobility Equipment Recyclers of New England LLC. By signing this agreement, renter acknowledges that they are receiving the rental equipment in good working condition. Renter will return the rented equipment in the same condition as when received. There will be an inspection conducted at the end of the rental period. In order to pass the inspection, the renter must make sure that the equipment is operating exactly as it was when initially received, and there is no damage that occured while in the renter’s possession. Mobility Equipment Recyclers of New England LLC may repossess the equipment without demand at any time if it is used in violation of the terms of this agreement. Mobility Equipment Recyclers of New England LLC shall not be liable or responsible for the loss of or damage to any property left, lost, damaged, stolen, stored or transported by renter, its agents, servants, employees, or any other person or person’s before, after or during the rental period. Renter assumes all risk of such loss or damage and waives all claims against Mobility Equipment Recyclers of New England LLC by reason thereof. Renter agrees to hold Mobility Equipment Recyclers of New England LLC harmless from and to defend and indemnify Mobility Equipment Recyclers of New England LLC against all claims based upon or arising out of such loss or damage. Renter assumes all risk and liability for including, but not limited to, any loss, damage or injury, including death, to persons, or property of Renter, or others arising out of the use, operation, transportation or driving of the equipment. Renter is responsible for the equipment and will reimburse Mobility Equipment Recyclers of New England LLC for the full cost of replacement and or repair for any damage, loss, theft, or destruction of the equipment. The Renter understands and authorizes that Mobility Equipment Recyclers of New England LLC will obtain any repair costs or replacement costs of the equipment. Renter acknowledges that reimbursement and or payment of these costs are the sole responsibility of the renter. The following restrictions are cumulative and each shall apply to every use, operation or driving of the equipment: Under no circumstances shall the equipment be used, operated by any person: a) under the age of 18 or b) while under the influence of intoxicants or narcotics; or c) in an unsafe manner. Renter shall defend, indemnify and hold harmless Mobility Equipment Recyclers of New England LLC all of their agents, officers, servants, and employees from and against any and all losses, liability claims, damages, injuries, demands, actions and causes of action whatsoever, arising out of or related to any loss, damage or injury claimed by persons that may arise from the use, operation, transportation or driving of the equipment, provided that such loss or damage was not caused by the fault or gross negligence and willful misconduct of Mobility Equipment Recyclers of New England LLC or its employees. Renter assumes all costs and expenses of every kind and nature, including legal fees and disbursements arising out of and in connection with the use, operation, transportation or driving of the equipment. Mobility Equipment Recyclers of New England LLC assumes no liability or responsibility for any acts or omissions of Renter or of Renters agents, servants, employees or other. Renter shall require users of equipment to operate the equipment with reasonable care and diligence and comply with the terms of this agreement. Renter shall notify Mobility Equipment Recyclers of New England LLC immediately of any and all accidents and damage resulting from the use, operation, transport or driving of the equipment. Renter agrees to pay all costs, expenses, and attorneys’ fees incurred by Mobility Equipment Recyclers of New England LLC in collecting sums due or in regaining possession of the equipment or in enforcing or recovering any damage, losses or claims against Renter. Renter, Renters agents, employees or the driver of the mobility equipment shall in no event be deemed the agent or employee of Mobility Equipment Recyclers of New England LLC in any manner or for any purpose whatsoever. Any individual executing this Agreement as Renter in a representative capacity shall be bound personally, jointly and severally, with such fiduciary, corporation or other entity as to all obligations, expressed or implied, arising hereunder. If any provisions hereof or the application of any provisions to any person or circumstance is held invalid or unenforceable, the remainder hereof and the application of such provision to other persons or circumstances shall remain valid and enforceable.
